Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.

1. ELIGIBILITY: The Olive Garden “Culinary Tours of Italy” Sweepstakes (“Sweepstakes”) is open only to persons who are legal residents of the 50 United States, and District of Columbia and Canada (excluding Quebec) who are 21 and older at the time of entry. Void in Guam, Puerto Rico, the U.S. Virgin Islands and other U.S. territories and possessions and where prohibited by law. Employees, retirees, and agents of GMRI, Inc.. (including their families and persons living in their households), Brandmovers, Inc. (“Administrator”), Cavit, Coppola, Colavita USA, LLC, Lotito Foods, Inc., and Birra Peroni Internazionale (“Promotional Participants”) and their respective parents, subsidiaries, and affiliates, agencies, distributors, and members of such employees’ immediate families and individuals living in the same household with such employees, are not eligible to enter or win.

2. SWEEPSTAKES ENTRY PERIODS/POOLS: The Sweepstakes begins at 8:00:00 a.m. Eastern Time (“ET”) on November 10, 2014 and ends at 7:59:59 a.m. ET on January 2, 2015 (“Promotion Period”). The Promotion Period consists of fifty-four (54) daily drawing pools (each, a “Daily Drawing Pool”), and one (1) grand prize drawing pool (the “Grand Prize Drawing Pool”). For purposes of this Sweepstakes, each Daily Drawing Pool will begin at 12:00:00 a.m. ET and end at 11:59:59 p.m. ET each day throughout the Promotion Period except for the first Daily Drawing Pool, which will begin at 8:00:00 a.m. ET. Entries must be received by 11:59:59 p.m. ET each day to be entered into that day’s Daily Drawing Pool except for the last Daily Drawing Pool, which will end at 7:59:59 a.m. ET. Entries must be received by 7:59:59 a.m. ET on January 2, 2015 to be entered into the Grand Prize Drawing Pool.

3. HOW TO ENTER: To enter, during the Promotion Period, visit http://www.italianfanfavorite.com (“Website”). Once you are on the Website, complete and submit the official registration form by providing your complete name and email address and link to at least one (1) social media site by: registering your Foursquare account, providing your email address connected to your Facebook account, providing your Instagram handle or providing your Twitter handle. PLEASE NOTE: You MUST link to at least one (1) external social media site in order to be eligible to enter a Daily Drawing Pool and you will receive one (1) additional entry for each social media site you link your entry to. After you register, you will automatically receive one (1) entry into that day’s Daily Drawing Pool and the Grand Prize Drawing Pool, simultaneously. Then, each day throughout the Promotion Period, each time you log on to the Website with your email address and vote for either #TeamNorth or #TeamSouth, you will automatically receive one (1) entry into that day’s Daily Drawing Pool, and the Grand Prize Drawing Pool simultaneously, but limit one (1) entry per Pool per day via this method of entry.

PLEASE NOTE: If you only want to enter the Grand Prize Drawing Pool, you may skip the registration process on the Website and instead, post a hashtag #TeamNorth or #TeamSouth (whichever chef you would like to vote for each day) via Twitter or Instagram during the Promotion Period to earn one (1) entry into the Grand Prize Drawing Pool only. Limit one (1) hashtag method of entry per person per Twitter account and one entry per person per Instagram account per person per day.

There are six (6) ways to receive additional entries into the Sweepstakes once you are registered as set forth above. Each time an additional entry is earned, that entry will automatically go into that day’s Daily Drawing Pool, and the Final Drawing Pool simultaneously.

1. Social Media Handle: During the registration process on the Website as set forth in Section 3 above, enter your social media handle for Twitter, Facebook, Instagram, and/or FourSquare and automatically receive one (1) entry per social media handle entered. Limit one (1) entry per social media handle for the entire Promotional Period.
2. Connect to Facebook: Provide your email address connected to your Facebook to earn one (1) entry into the Sweepstakes. Limit one (1) entry per this additional method of entry per person per Promotion Period.
3. Tweet with Hashtag: Tweet hashtag #TeamNorth or #TeamSouth (whichever chef you would like to vote for each day) during the Promotion Period to earn one (1) entry into the Sweepstakes. Limit one (1) entry per this additional method of entry per person per day.
4. Post to Instagram: Post hashtag #TeamNorth or #TeamSouth (whichever chef you would like to vote for each day) during the Promotion Period to earn one (1) entry into the Sweepstakes. Limit one (1) entry per this additional method of entry per person per day.
5. “Share” the Promotion via Email: Every time you share the Sweepstakes with a friend via email and that friend successfully enters the Sweepstakes, you will automatically receive one (1) entry into the Sweepstakes per friend.
6. Connect and Check-in to Foursquare: Connect to Olive Garden via Foursquare app on the Website. After connecting, each time you visit an Olive Garden restaurant during the Promotion Period, check-in via Foursquare and earn one (1) entry into the Sweepstakes. Limit one (1) entry per this additional method of entry per person per day.

The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or Foursquare. Any questions, comments or complaints regarding the Sweepstakes should be directed to Sponsor, not Facebook, Twitter, Instagram or Foursquare. By entering, you are providing the information to Sponsor, and not to Facebook, Twitter, Instagram, or Foursquare.

4. RANDOM DRAWINGS: Each Monday throughout the Promotion Period, Administrator will conduct random drawings for the previous week’s Daily Drawing Pools to award the specific number of Daily Prizes as set forth in the Daily Drawing Prize chart, from among all eligible entries received in each Daily Drawing Pool. Then, on or about January 5, 2015, Administrator will conduct a random drawing to award the two (2) Grand Prizes from among all eligible entries received in the Grand Prize Drawing Pool. The Daily Prize Winners will be notified by email on the day of each drawing. The potential Grand Prize Winners will be notified by email or private message on or about the day of the Grand Prize drawing and will have 72 hours from the time the winner notification is sent by Administrator to respond. In the event any potential Grand Prize Winner fails to respond to the winner notification with 72 hours, he/she will forfeit his/her right to the Grand Prize and the Grand Prize may, at Sponsor’s sole discretion, be awarded to an alternate, time permitting. Upon receiving the winner notification response, Administrator will send an Affidavit of Eligibility and Liability and Publicity Release to potential Grand Prize winner and the winner will have five (5) days to complete and submit the required paperwork. If any potential Grand Prize winner fails to submit the required paperwork within five (5) days, or fails to meet eligibility requirements he/she forfeits his/her right to the Grand Prize and the Grand Prize may, at Sponsor’s sole discretion, be awarded to an alternate winner, time permitting. In the event the potential Grand Prize Winner is a resident of Canada, the potential Grand Prize Winner must first correctly answer a required time-limited mathematical skill-testing question without any assistance of any kind, whether mechanical or otherwise, prior to being deemed the Grand Prize Winner. Winners are solely responsible for any and all applicable fees and taxes associated with receipt and use prize, and each Grand Prize winner will receive an IRS Form 1099 reflecting the actual final retail value of the Grand Prize, or such other governmental tax forms that may be necessary, as determined in the sole discretion of Sponsor. All Daily Prizes will be emailed to each Daily Prize winner. If any Prize notification or attempted notification is returned as undeliverable, the Prize will be forfeited and may be awarded to an alternate winner, time permitting. By accepting any Prize, Winners acknowledge compliance with these Official Rules. Any non-winning entries from any Daily Drawing Pool WILL be carried over to the next drawing pool.

Odds of winning depend upon the number of eligible entries received in each Drawing Pool.

5. PRIZES AND CONDITIONS FOR AWARDING PRIZE: Winners must meet all eligibility requirements. In the event a Winner is deemed ineligible, or is not available to claim prize during specified dates, then an alternate winner may be selected at random from eligible Entries received per Drawing Pool, time permitting.

6. Prizes and Approximate Retail Values (“ARVs”):

Two (2) Grand Prize Winners – Each Grand Prize Winner will receive a package consisting of: a 6-night/7-day trip for two (2) to a Sponsor-specified city in either Northern or Southern Italy. There will be one winner to each location. Trip consists of coach airfare for two (2) people from major international airport nearest winner’s residence to a Sponsor-specified city in Northern or Southern Italy, six (6) nights hotel accommodations (one room, double occupancy) in a hotel selected by Sponsor, transportation to/from airport/hotel in Italy, three (3) meals per day will be provided by Sponsor for a total of seven (7) days, and any other benefits Sponsor may provide in connection with the Promotion. Trip must be completed during the month of May 2015 or the prize will be forfeited. Package does not include additional nights or incidental expenses. Travel arrangements must be made by March 1, 2015. Airline and flight times for trip are to be selected at Sponsors’ sole discretion. Travel must be roundtrip and no refund or compensation will be made in the event of cancellation or delay of any flight. Travel arrangements are subject to air/hotel availability, airline restrictions, airline ticket terms and conditions, and blackout dates. Airlines tickets may not be upgraded, assigned or transferred and are non-refundable. Winner and his/her guest must travel together at the same time and on same itinerary. Air transportation and hotel accommodations must be taken together and cannot be taken separately. Guest for each trip must be twenty-one (21) years of age unless child or legal ward of winner and must execute and return a liability/publicity release prior to issuance of travel documents. Winner may also be required to execute liability waivers and other releases for each and every trip. All taxes, traveling fees, and surcharges, not listed in the package listed above, are the sole responsibility of the prize winner. Once trip dates have been booked, no change, extension or substitution of trip dates is permitted, except at Sponsor’s sole discretion. Sponsor will not replace any lost or stolen tickets, travel vouchers, certificates or similar items. Prize winner and guest are responsible for obtaining travel documents including passports, visas, immunizations and medications as well as travel insurance. ARV: $5,000 each. Total ARV: $10,000. Winner will not receive the difference of actual value and approximate retail value. Limit one (1) Sweepstakes Grand Prize per person.

There will be a total of two thousand and seven (2,007) Daily Winners:

• Two thousand (2,000) Daily Winners will receive a $5.00 Olive Garden e-Gift Card. Gift card must be printed from the winning notification email. e-Gift card is subject to the terms, conditions and restrictions printed on the card. ARV: $5.00 each. Total ARV: $10,000
• Seven (7) Daily Winners will receive a Gift Basket consisting of:
  • (a) one (1) Simply Italian Gift Basket from Colavita that includes balsamic vinegar, Italian Olive Oil, Cherry Tomatoes, Eggplant and Sweet Peppers, Pesto, one pound each of artisanal, whole wheat and traditional pasta, marinara and vodka sauces;
  • (b) Specialty Cheeses and products from Lotito that includes grated Parmesan and pecorino romano cheeses, Biscotti, sun dried tomatoes;
  • (c) Branded merchandise from Peroni that includes Peroni glasses, 1 Large Peroni T-Shirt, 1 Peroni bottle opener; and
  • (d) Branded merchandise from Cavit that includes Tshirt, cork pull, stopper, foil cutter, coupons

The ARV for the Gift Basket: $171 each. Total ARV: $1,197.

The total ARV for all prizes is $21,197.

Prize winners are responsible for all applicable taxes which may be incurred by winning the Prize. The Prizes consist of only those items specifically listed as part of the Prize. All Prizes are non-transferable and non-assignable. All prizes are subject to terms, conditions, and restrictions as noted on the prize. No cash redemption or Prize substitution allowed by the winners. Sponsor reserves the right to substitute a Prize of equal or greater value if any Prize is unavailable and/or undeliverable for any reason in the sole and complete discretion of Sponsor. Any difference between the stated ARV of any Prize and the actual ARV will not be awarded.

9. PRIVACY: Sponsor and its authorized agents will collect, use, and disclose the personal information you provide when you enter the Sweepstakes solely for the purposes of administering the Sweepstakes and fulfilling prizes, and by entering this Sweepstakes you consent to the collection, use, disclosure and management of your personal information for said purposes. All personal information that entrants submit will be subject to Sponsor’s privacy policy. In the event of any discrepancy between Sponsor’s privacy policy and these Official Rules, the privacy policy will govern and control. 10. OTHER CONDITIONS: Mass Entries or Entries generated by a script, macro or use of automated methods will be disqualified. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. If canceled, Sponsor reserves the right at its discretion to determine the Winner using all non-suspect eligible Entries received up to the time of cancellation. Sponsor is not responsible for failed, partial or garbled computer transmissions or text messages, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries; any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers, computer equipment, or software; failure of any e-mail or electronic Entry to be received on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this Sweepstakes. In the event of a dispute over an electronic Entry, prize will be awarded to the owner of the email address, not the name on the Entry form. IN NO EVENT WILL THE SPONSOR, ADMINISTRATOR, PROMOTIONAL PARTICIPANTS, FACEBOOK, TWITTER, INSTAGRAM, OR FOURSQUARE BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE WEBSITE ASSOCIATED WITH THIS CONTEST. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEBSITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. All Entries become the sole property of the Sponsor and will not be acknowledged or returned. Incomplete and duplicate entries will be disqualified. All federal, state and local laws and regulations apply. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes; (b) the Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these rules; or (c) the Sweepstakes is otherwise not capable of running as planned. By entering, entrants agree to release and hold harmless Sponsor, Administrator, Promotional Participants, Facebook, Twitter, Instagram, Foursquare, and each of their parents, subsidiaries, affiliates, divisions, advertising and promotional agencies, wholesalers and retailers, contractors, subcontractors, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the ‘‘Released Parties”), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Sweepstakes or acceptance, delivery, or use of any prize, including without limitation, any Prize. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any entry to be received by Sponsor due to technical problems, human error or traffic congestion on the Internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the Sweepstakes, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of Entries and/or entry information, or (vi) Entries which are late, lost, stolen, damaged, illegible and/or unintelligible (or any combination thereof). By entering, entrants (or entrant’s parent/legal guardian if entrant is deemed a minor in the state of his/her residence) agree to comply with these Official Rules. Any entrant who attempts to tamper with this Sweepstakes in any way shall be disqualified. Additional restrictions may apply.

11. PUBLICITY RELEASE: By entering this Sweepstakes, entrants agree that Sponsor may use entrant’s name and photograph on Sponsor’s website or other mediums without compensation, credit or right of review or approval. Where legal, acceptance of any Prize constitutes Winner’s consent to use, publish, and reproduce for all purposes, including publicity, promotion and advertising, in any media (including online and offline), Prize Winner’s name, city, photograph, likeness, voice and image, in perpetuity without further compensation, credit or right of review or approval.

Sponsor reserves the right to conduct background checks on any or all entrants, and Sponsor reserves the right to disqualify any entrant based on such background check if Sponsor determines in its sole discretion that awarding a prize to any such entrant, or publicizing any facts or details about such entrant, might reflect negatively on Sponsor or any of its Sweepstakes suppliers or partners. Entrants will cooperate with Sponsor and its representatives in connection with any and all verification and background check activities.

12. ARBITRATION/CHOICE OF LAW: Except where prohibited by law, participants agree that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by entrant with regard to this Sweepstakes and shall exclude in all events attorneys’ or other related fees and punitive, incidental, consequential or other damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Florida. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. YOU WAIVE ANY RIGHT TO A TRIAL BY JURY, and agree that any claim or dispute shall be resolved individually, without resort to any form of class action.
